        Raport\u00f6r g\u00f6r\u00fc\u015f\u00fcn\u00fc i\u00e7erir raporunu Kurulumuza sunmu\u015ftur.<\/p>\n

        Kurulumuz t\u00fcm \u00fcyeleri taraf\u0131ndan sunulan rapor ve ba\u015fvurucuya ait kararlar incelenerek, T.C. Anayasas\u0131 ve ceza hukuk mevzuat\u0131, T\u00fcrkiye\u2019nin taraf oldu\u011fu uluslararas\u0131 s\u00f6zle\u015fme h\u00fck\u00fcmleri, Avrupa \u0130nsan Haklar\u0131 Mahkemesi ve Birle\u015fmi\u015f Milletler ilgili komite ve komisyon kararlar\u0131 ile Avrupa Konseyi, Avrupa Birli\u011fi ve Venedik Komisyonu\u2019nun T\u00fcrk yarg\u0131 sistemi, mahkemelerin i\u015fleyi\u015fi, temel hak ve \u00f6zg\u00fcrl\u00fcklerin ihlaline ili\u015fkin rapor ve g\u00f6r\u00fc\u015fleri do\u011frultusunda de\u011ferlendirme yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n

        Ba\u015fvurucu Sivas ilinde savc\u0131 olarak g\u00f6rev yapmakta iken 15 Temmuz darbe te\u015febb\u00fcs\u00fc gerek\u00e7e olarak kullan\u0131larak 16 Temmuz 2016 tarihinde sabah erken saatlerinde HSK taraf\u0131ndan a\u00e7\u0131\u011fa al\u0131nm\u0131\u015f ve ayn\u0131 g\u00fcn Ankara Ba\u015fsavc\u0131l\u0131\u011f\u0131 taraf\u0131ndan hakk\u0131nda \u00f6rg\u00fct \u00fcyeli\u011fi ve darbeye te\u015febb\u00fcs su\u00e7lamas\u0131 ile soru\u015fturma ba\u015flat\u0131lm\u0131\u015f ve tutuklanmas\u0131 talep edilmi\u015ftir. Ba\u015fvurucu 21 Temmuz 2016 tarihinde tutuklanm\u0131\u015f ve 27 Aral\u0131k 2018 tarihine kadar tutuklu kalm\u0131\u015ft\u0131r.<\/p>\n

        Ba\u015fvurucu hakk\u0131nda Ankara CUmhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131 taraf\u0131ndan 22 Eyl\u00fcl 2017 \u00fctarihinde silahl\u0131 ter\u00f6r \u00f6rg\u00fct\u00fc \u00fcyeli\u011fi su\u00e7lamas\u0131 ile dava a\u00e7\u0131lm\u0131\u015f, ayn\u0131 tarihte tutukland\u0131\u011f\u0131 darbeye te\u015febb\u00fcs su\u00e7u ile ilgili kovu\u015fturmaya yer olmad\u0131\u011f\u0131 karar\u0131 verilmi\u015ftir. Ba\u015fvurucu darbeye te\u015febb\u00fcs su\u00e7undan bu karar sonras\u0131nda tahliye edilmi\u015ftir.<\/p>\n

        KARARLARDA OMUT VE HUKUKEN KABUL ED\u0130LEB\u0130L\u0130R B\u0130R DEL\u0130L BULUNUP BULUNMADI\u011eINA \u0130L\u0130\u015eK\u0130N \u0130NCELEME:<\/strong><\/p>\n

        Kurulumuza sunulan h\u00e2kimlik (veya mahkeme) kararlar\u0131 incelendi\u011finde, Ceza Muhakemesi Kanunu\u2019nun 100.maddesinde tutuklamaya ili\u015fkin \u015fartlar\u0131n olu\u015ftu\u011funa dair karar\u0131 okuyan \u00fc\u00e7\u00fcnc\u00fc ki\u015fiyi ikna edebilecek bir delil de\u011ferlendirilmesi yap\u0131lmad\u0131\u011f\u0131; sadece kanunda yaz\u0131l\u0131 ifadelerin tekrar\u0131yla yetinildi\u011fi; s\u00f6z konusu delillerin hukukili\u011fi noktas\u0131nda bir de\u011ferlendirme ve inceleme yap\u0131lmad\u0131\u011f\u0131; A\u0130HM\u2019in 5.madde kapsam\u0131ndaki i\u00e7tihatlar\u0131nda belirlenen delil ve delil de\u011ferlendirme kriterlerinin kar\u015f\u0131lanmad\u0131\u011f\u0131, Anayasa ve uluslararas\u0131 s\u00f6zle\u015fmelerle teminat alt\u0131na al\u0131nan haklar\u0131n kullan\u0131m\u0131n\u0131n geriye d\u00f6n\u00fck ve ayr\u0131mc\u0131l\u0131k temelli olarak ki\u015fi aleyhine su\u00e7lama delili olarak kullan\u0131ld\u0131\u011f\u0131 Kurulumuz taraf\u0131ndan g\u00f6zlemlenmi\u015ftir.<\/p>\n

        KARARLARIN GEREK\u00c7EL\u0130 OLUP OLMADI\u011eI HUSUSUNDA YAPILAN \u0130NCELEME:<\/strong><\/p>\n

        Anayasa\u2019n\u0131n 141.maddesi ile emredilen ve CMK\u2019n\u0131n 34.maddesinde tekrarlanan ve uluslararas\u0131 insan haklar\u0131 s\u00f6zle\u015fmeleri ile g\u00fcvence alt\u0131na al\u0131nan, mahkeme ve h\u00e2kimlik kararlar\u0131n\u0131n gerek\u00e7eli olmas\u0131 \u015fart\u0131n\u0131n kar\u015f\u0131lanmad\u0131\u011f\u0131; \u00a0sebep-sonu\u00e7 ili\u015fkisi tesis edilmedi\u011fi, s\u00f6z konusu kararlarda sadece yasa maddelerinde yer alan \u00f6l\u00e7\u00fctlerin tekrar edildi\u011fi, kararlarda bireyselle\u015ftirme yap\u0131lmad\u0131\u011f\u0131, \u00f6l\u00e7\u00fcl\u00fcl\u00fck-orant\u0131l\u0131l\u0131k-gereklilik gibi k\u0131staslar\u0131n kar\u015f\u0131lanmad\u0131\u011f\u0131, bu nedenle ba\u015fvurucunun karara kar\u015f\u0131 etkin bir itiraz hakk\u0131 kullanmas\u0131n\u0131n \u00f6nlendi\u011fi g\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n

        Bu haliyle s\u00f6z konusu kararlar\u0131n gerek\u00e7esiz oldu\u011funun kabul edilmesi gerekti\u011fi kanaatine var\u0131lm\u0131\u015ft\u0131r.<\/p>\n

        KARARLARI VEREN H\u00c2K\u0130M VE SAVCILARIN TARAFSIZLI\u011eINA VE BA\u011eIMSIZLI\u011eINA DA\u0130R DE\u011eERLEND\u0130RMELER:<\/strong><\/p>\n

        2014 sonras\u0131 T\u00fcrk yarg\u0131 sisteminin ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131na ve hakimlik-savc\u0131l\u0131k teminat\u0131na dair d\u00fczenlenen\u00a0AB \u0130lerleme Raporlar\u0131<\/a>,\u00a0BM Komite ve Komisyon Kararlar\u0131<\/a>,\u00a0Venedik Komisyonu Karar\u0131<\/a>,\u00a0A\u0130HM\u00a0<\/a>i\u00e7tihatlar\u0131<\/a>,\u00a0MEDEL ve di\u011fer Avrupa hakim ve savc\u0131 \u00f6rg\u00fctleri raporlar<\/a>\u0131, uluslararas\u0131\u00a0insan haklar\u0131 \u00f6rg\u00fctleri rapor<\/a>\u00a0ve de\u011ferlendirmeleri birlikte incelendi\u011finde, yarg\u0131n\u0131n \u00fczerinde siyasetin yo\u011fun bir etkisinin oldu\u011fu, hakim ve savc\u0131lar\u0131n atama, nakil ve yetkilendirme yetkilendirilmelerinin \u015feffaf ve denetlenebilir olmad\u0131\u011f\u0131, iktidar aleyhine karar veren hakim ve savc\u0131lar\u0131n g\u00f6rev yerlerinin de\u011fi\u015ftirildi\u011fi, haklar\u0131nda disiplin soru\u015fturmas\u0131 ba\u015flat\u0131ld\u0131\u011f\u0131 veya ihra\u00e7lar\u0131na karar verildi\u011fi; yap\u0131lan yasal d\u00fczenlemeler ile yarg\u0131n\u0131n i\u015fleyi\u015fine do\u011frudan m\u00fcdahale edildi\u011fi, siyasi y\u00f6n\u00fc bulunan soru\u015fturma ve yarg\u0131lamalarda A\u0130HM i\u00e7tihatlar\u0131 ile somutla\u015fan ve \u00e7er\u00e7evesi \u00e7izilen ilke ve usullere riayet edilmedi\u011fi anla\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n

        Hukuka uygunlu\u011fu tart\u0131\u015fmal\u0131 delillere dayal\u0131 olarak, gerek\u00e7esiz \u015fekilde verilen tutuklama ve tutukluluk devam kararlar\u0131 ve bu kararlar neticesinde uzunca s\u00fcre ba\u015fvurucunun tutuklu kalmas\u0131 ile karardalar yer verilen \u00f6n kabuller birlikte de\u011ferlendirildi\u011finde s\u00f6z konusu yarg\u0131 mensuplar\u0131n\u0131n \u00f6nyarg\u0131l\u0131, tarafl\u0131 ve ayr\u0131mc\u0131l\u0131k temelli bir yakla\u015f\u0131m sergiledikleri konusunda taraf\u0131m\u0131zda kuvvetli bir \u015f\u00fcphe olu\u015fmu\u015ftur.<\/p>\n

        Verilen kararlar\u0131n Ceza Hukuku ve Ceza Yarg\u0131lama Hukukunun temel ilkelerine tamamen ayk\u0131r\u0131 oldu\u011fu, karar veren h\u00e2kim ve savc\u0131lar\u0131n verdikleri kararlarda ba\u015fvurucuya atfedilen su\u00e7un yasal \u015fartlar\u0131n\u0131n olu\u015fup olu\u015fmad\u0131\u011f\u0131na dair de\u011ferlendirmelerden ziyade, ba\u015fvurucunun ideolojisini, dini g\u00f6r\u00fc\u015f\u00fcn\u00fc, ait oldu\u011fu sosyal grubu, \u0131rk\u0131n\u0131 ve\/ya siyasi tercihlerinin g\u00f6z\u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131, b\u00f6ylece Yarg\u0131\u00e7lar\u0131n objektif ve s\u00fcbjektif ba\u011f\u0131ms\u0131zl\u0131klar\u0131n\u0131n, savc\u0131lar\u0131n ise tarafs\u0131zl\u0131klar\u0131n\u0131 kaybettikleri konusunda Kurulumuzda kanaat olu\u015fmu\u015ftur.<\/p>\n

        KARARI VERENLER\u0130N HUKUK\u0130 SORUMLULU\u011eUNUN DE\u011eERLED\u0130R\u0130LMES\u0130 VE SONU\u00c7:<\/strong><\/p>\n

        Ba\u015fvurucunun talebi do\u011frultusunda yap\u0131lan inceleme sonucunda, s\u00f6z konusu kararlar\u0131n uluslararas\u0131 insan haklar\u0131 hukuku \u00e7er\u00e7evesinde kabul edilen ilke ve gereklilikleri kar\u015f\u0131lamad\u0131\u011f\u0131, bu nedenle s\u00f6z konusu kararlar\u0131n hukuken me\u015fru ve kabul edilebilir, sonu\u00e7 do\u011furacak nitelikte olmad\u0131klar\u0131 Kurulumuzca de\u011ferlendirilmi\u015ftir.<\/p>\n

        Yukar\u0131da yer verilen gerek\u00e7eler ve kabule g\u00f6re, Ba\u015fvurucunun tutuklanmas\u0131na ili\u015fkin olarak soru\u015fturma ve yarg\u0131lama a\u015famas\u0131nda g\u00f6rev yapan h\u00e2kim ve savc\u0131lar\u0131n muhtemel hukuk\u00ee sorumluluklar\u0131 Kurulumuzca a\u015fa\u011f\u0131daki gibi tespit edilmi\u015ftir:<\/p>\n
